What Is the Adjustment of Status Process?

The adjustment of status process is governed by the Immigration and Nationality Act (INA). The INA is the primary immigration law in the United States, and it regulates immigration in several ways, including by establishing different types of immigration visas.

The adjustment of status process is used to change your immigration status in the United States. If you are currently in the United States on a nonimmigrant visa, you can use the adjustment of status process to obtain a green card.

When you adjust your status, you do so while you are still in the United States. You do not need to leave the country and return as a lawful permanent resident.

Types of Non-Immigrant Visas

There are several different types of nonimmigrant visas that people may be in the United States on. These include:

  • B-1: Business visitor
  • B-2: Tourist
  • H-1B: Specialty occupations
  • L-1: Intra-company transferee
  • O-1: Individuals with extraordinary abilities
  • P-1: Athletes and entertainers
  • P-2: Artists and entertainers
  • Q-1: International cultural exchange
  • Q-2: International cultural exchange
  • Q-3: International cultural exchange
  • Q-4: International cultural exchange
  • TN: Canadian and Mexican professionals

The specific circumstances of your situation will determine which visa you are on and what options are available to you.

In general, if you are in the United States on a nonimmigrant visa, you can adjust your status if:

  • You have a qualifying family relationship with a U.S. citizen or lawful permanent resident
  • You have a qualifying employment relationship with a U.S. business
  • You have a qualifying investment relationship with a U.S. business
  • You have an approved employment-based immigrant visa petition
  • You have an approved immigrant visa petition based on your special immigrant status (as a victim of a crime)
  • You are a member of the employment-based second preference category

If you meet one of these criteria, you can submit an application to adjust your status. The application will need to be supported by documentation that proves your eligibility. Once your application is approved, you will be permitted to adjust your status. This means that you will be granted lawful permanent resident status and receive a green card.

Once you have received your green card, you can begin the process of applying for U.S. citizenship. You will need to meet certain eligibility requirements, take the Oath of Allegiance, and complete the naturalization process.

What Is the Difference Between a Green Card & a Visa?

A green card and a visa are both types of legal documents that allow you to enter and remain in the United States. The main difference between the two is that a visa is temporary, while a green card is permanent.

Visas are issued by U.S. consular officers outside of the United States when you are applying for a visa. A visa allows you to enter the country for a specific purpose. For example, if you are applying for a B-2 tourist visa, you will be in the United States for a limited period of time (up to 6 months) to travel, visit friends or relatives, or participate in business or educational activities. If you are applying for an H-1B specialty occupation visa, you will be in the United States for a limited period of time (up to 3 years) to work for a specific employer. If you are applying for a green card, you will be in the United States for an indefinite period of time.
